This Privacy Policy explains how Cutts Technologies LLC, operating Fixed Rate Electric Plans (“Fixed Rate Electric Plans,” “we,” “us,” or “our”), handles information when you use FixedRateElectricPlans.com.

Cutts Technologies LLC is a registered Texas electricity broker. PUCT Broker Registration Number: BR260147.

1. Scope

This Privacy Policy applies to information handled through the Fixed Rate Electric Plans website and marketplace.

Fixed Rate Electric Plans is a comparison and brokerage service. You do not need to create an account to use the Site.

When you choose a plan and proceed to enrollment, the enrollment experience is hosted by PowerHQ, the applicable retail electric provider (“REP”), or another provider-authorized service. Information you enter into that enrollment experience is handled by that third party under its own privacy practices.

2. Information Used While You Shop

When you use the marketplace, the Site may process information you choose to provide or select, such as:

  • ZIP code;
  • selected delivery utility or service territory;
  • electricity-usage level;
  • plan filters;
  • plans viewed or selected; and
  • the plan identifier needed to continue to enrollment.

At this time, these shopping selections are used to provide the requested marketplace experience and are not stored by Fixed Rate Electric Plans in a customer database.

The Site does not currently create customer accounts or persistent shopper profiles.

3. Technical Information and Rate Limiting

Our hosting and application infrastructure processes limited technical information needed to operate and protect the Site.

For certain requests, including plan searches and enrollment redirects, we may temporarily process your:

  • IP address; and
  • related request information necessary to apply security and rate limits.

The current rate-limiting system uses the IP address temporarily in application memory to prevent abuse. It is not associated with a customer account or shopping profile and is cleared as the rate-limit data expires.

Our hosting provider may also process ordinary server and network information as part of providing and securing the website.

4. Cookies, Analytics, and Advertising

Fixed Rate Electric Plans uses the following measurement technologies on this deployment:

  • Google Analytics 4, to understand how visitors find and use the Site;
  • Microsoft Clarity, which measures page interactions such as clicks, scrolling and navigation, and records a playback of how pages were used;
  • cookies and similar browser storage set by those Google and Microsoft services.

We ask before any of this happens. On your first visit the Site shows a notice with an Accept and a Decline option, and no measurement script is loaded until you choose Accept. If you decline, or if you simply do not answer, no measurement script is loaded, no measurement cookie is set, and no request is made to Google and Microsoft at all. Declining does not limit anything you can do on the Site.

Your choice is stored on your own device so we do not ask again on every page. You can change it by clearing this site's data in your browser, which returns the Site to its unanswered state and shows the notice again.

Separately from any measurement, the Site sets one short-lived cookie of its own to remember the ZIP code you are shopping while you compare plans. It is set only after you search, it expires after two hours, it cannot be read by any script on the page, and it is not used for advertising or for building a profile. It is set whether or not you accept measurement, because without it the Site cannot show you plans.

Advertising and advertising-personalisation signals are set to denied for every visitor, including visitors who accept. We tell Google and Microsoft this explicitly rather than leaving it unstated.

These services set cookies or similar identifiers in your browser and receive information about your visit, including pages viewed, approximate location derived from your IP address, device and browser information, and how you arrived at the Site. Google and Microsoft act as our service providers for this measurement and process that information under their own terms.

We measure steps in the shopping process rather than individuals: a page view, a ZIP search and the delivery territory it resolved to, a utility choice where a ZIP is split, a results view with the number of plans shown and the usage level selected, a change of usage level or filter, a plan selection, the start of a provider enrollment handoff, and whether the provider's hosted checkout loaded.

We keep the ZIP code you search. It is what identifies the delivery territory and therefore which plans are genuinely available to you, and we also use searches — the ZIP, the territory, the time, how many plans came back, and how far through the comparison somebody got — to understand demand across Texas markets and to improve the Site. That record is ours and stays with us.

It is not attached to a name, an email address, a telephone number, a street address, an ESI ID, or anything you enter into the provider-hosted enrollment experience, because the Site does not collect those. There are no accounts and no sign-in. Where we need to connect the steps of one shopping visit we use a random identifier created for that visit, which expires with it and identifies nobody.

Google and Microsoft do not receive your ZIP code. It is not in the measurement events we send, it is not in the web address of any page — plan results are shown at an address that carries no ZIP code — and the cookie that holds it while you shop cannot be read by any script on the page. Plan identifiers are converted to a non-reversible reference before they are recorded. Nothing you enter into the provider-hosted enrollment experience reaches them either; that form is on the provider's own domain and the Site cannot read it.

Microsoft Clarity records a playback of how pages were used — where a visitor scrolled, what they clicked, how long they stayed. What you type is not part of it: Clarity masks the contents of every input field and drop-down in all of its modes, and the ZIP field on this Site carries an explicit masking instruction as well. The playback shows how a page was used, not what was entered into it.

Sensitive enrollment information entered into the PowerHQ or provider-hosted enrollment experience remains outside our measurement entirely. That form is hosted on the provider's own domain, the Site cannot read it, and none of it appears in any measurement event.

Fixed Rate Electric Plans does not know whether an enrollment was completed. We measure that a checkout was started and that a provider's checkout page loaded; neither is a completed enrollment, and we do not report either as one.

We hold accounts with additional advertising providers that are not installed on the Site: Meta, for advertising measurement and campaign attribution; and Nextdoor, for advertising measurement and campaign attribution. No script, pixel, cookie or identifier belonging to any of them is present on the Site. If we install any of them, we will update this Privacy Policy.

You can decline measurement using the notice described above, and you can additionally limit it using your browser's cookie controls or Google's and Microsoft's own opt-out tools. Doing so does not affect your ability to compare plans or to enroll.

4a. Campaign Attribution

When you arrive from an advertisement, a search result, or a link somebody shared, the address you arrive at may carry campaign parameters such as utm_source, utm_medium, utm_campaign, utm_content, utm_term, or a Google click identifier.

We use those parameters to understand which channels and campaigns bring visitors who find the Site useful. They describe where a visit came from; they do not identify you, and we do not use them to build a profile.

Campaign parameters are not part of the canonical address of any page. Search engines are directed to the clean address, so a shared or advertised link does not create a separate version of a page.

5. Information Entered During Electricity Enrollment

When you select a plan, the actual electricity enrollment process is hosted by PowerHQ, the applicable REP, or another provider-authorized service.

Fixed Rate Electric Plans does not ask you to enter raw payment-card numbers, Social Security numbers, dates of birth, identity-verification answers, or similar sensitive enrollment information directly into our marketplace pages.

Information requested within the provider-hosted enrollment experience may include information needed by the REP to establish electric service. That information is submitted directly through the third-party enrollment system.

Depending on the provider, that enrollment experience may open on the third party's own website or appear within a frame on our page. In both cases the form belongs to the third party, is served from its own domain, and is not readable by this Site.

Fixed Rate Electric Plans does not currently receive enrollment information back from PowerHQ through a webhook, callback, browser message, or similar automated mechanism.

We may, now or in the future, receive limited operational information from PowerHQ or a retail electric provider in the ordinary course of business — for example the plan and provider selected, a referral or attribution code we supplied, a checkout or session identifier, whether an enrollment was completed, and commission or reconciliation records. Information of this kind is used to operate and account for the marketplace.

Operational information of that kind does not include the sensitive enrollment details described above. We do not receive your Social Security number, date of birth, identity-verification answers, credit-check results, or the payment credentials you give a provider.

The third party's own privacy policy and terms govern information you provide through its enrollment system.

6. Communications With Us

If you contact Fixed Rate Electric Plans by email or another approved contact method, we may receive information you voluntarily provide, such as:

  • your name;
  • email address;
  • the contents of your message; and
  • information reasonably necessary to respond to your question or complaint.

We use that information to respond to you, investigate issues, meet regulatory obligations, and maintain appropriate business records.

7. How We Use Information

We may use information processed through the Site to:

  • display fixed-rate electricity plans for the ZIP code and service territory you request;
  • calculate and display plan costs based on the usage level you select;
  • apply the filters and selections you request;
  • allow you to proceed to the enrollment experience for a selected plan;
  • operate, secure, and protect the Site;
  • prevent abuse and excessive automated requests;
  • troubleshoot technical problems;
  • respond to questions and complaints;
  • comply with applicable legal and regulatory obligations; and
  • maintain records where required by law.

We do not use proprietary electricity-customer information for unrelated purposes.

8. How We Share Information

Fixed Rate Electric Plans does not currently operate a customer database containing marketplace shopper profiles for sale or marketing distribution.

We may allow information to be processed or disclosed where reasonably necessary:

Service Providers

Companies that provide hosting, infrastructure, security, or technical services may process limited information as necessary to provide those services to us.

At Your Direction

When you choose to continue with an electricity plan, your browser connects to the applicable PowerHQ or provider-hosted enrollment service so you can complete enrollment.

Legal and Regulatory Requirements

We may preserve or disclose information when required or permitted by applicable law, court order, governmental process, or a request from the Public Utility Commission of Texas or another authority with jurisdiction.

Categories of Information That May Be Shared

Depending on which of the situations above applies, the categories are:

  • shopping context — the delivery territory your ZIP resolved to, the usage level and filters you chose, and the plan and provider you selected;
  • technical and security information — IP address, browser and device information, and request metadata used to serve pages and to limit abuse;
  • enrollment and attribution information — the plan and provider selected, any referral or attribution code, a checkout or session identifier, and enrollment status or commission records where a partner supplies them; and
  • information you choose to send us directly, such as the contents of an email.

These categories do not include your Social Security number, date of birth, identity-verification answers, credit-check information, or payment credentials. Those are entered into the provider-hosted enrollment experience and are not collected by us.

Categories of Third Parties

  • enrollment platform providers, currently PowerHQ;
  • retail electric providers whose plans appear on the Site;
  • hosting, cloud and content-delivery infrastructure providers;
  • analytics providers, where analytics is enabled;
  • advertising and advertising-measurement providers, where advertising measurement is enabled;
  • security and anti-abuse providers;
  • professional advisers such as legal and accounting providers, where ordinary business operations require it; and
  • regulators, courts and law-enforcement authorities where legally required, including the Public Utility Commission of Texas.

We share information with a category of third party only for the purposes described in this Policy. We do not share information with third parties for them to market their own unrelated products to you.

9. Sale of Personal or Proprietary Client Information

Fixed Rate Electric Plans does not currently sell personal information collected through the marketplace for money.

We do not sell or make proprietary client information obtained through our electricity-brokerage activities available for sale except as authorized or permitted by applicable law.

We do not currently use personal information collected through the marketplace for targeted advertising.

10. Data Retention

Because the marketplace does not currently create customer accounts or store ZIP searches, usage selections, or plan selections in a customer database, most shopping information is request-scoped rather than retained by Fixed Rate Electric Plans.

Temporary IP-based rate-limit information expires automatically from application memory.

Fixed Rate Electric Plans operates an internal editorial system used by our own staff to research and publish the articles, guides and research on this Site. It stores editorial drafts and published content, links to published news sources, and an internal record of which staff member made which change. It does not contain shopper information: no ZIP searches, no plan selections, no enrollment information, and no visitor profiles.

Published editorial content remains available while it is published and is retained afterwards as part of our business records. Internal editorial records are retained for as long as reasonably necessary for the purpose for which they were created.

Where analytics or advertising measurement is enabled, the retention of the information collected by those services is controlled by the provider under its own policies and settings rather than by us.

Operational enrollment and referral records received from an enrollment platform or provider, where we receive them, are retained for as long as reasonably necessary for the purpose for which the information was collected, to meet legal, regulatory and accounting obligations, or to protect the service.

Information you send to us directly, and records required for legal, regulatory, accounting, complaint-handling, or business purposes, may be retained for an appropriate period.

Certain electricity-broker records may be retained for at least the period required by applicable PUCT rules.

11. Security

We use reasonable administrative and technical measures designed to protect the systems and information handled by Fixed Rate Electric Plans.

We also limit the sensitive information handled directly by the marketplace. Sensitive information required for electricity enrollment is entered into the applicable provider-hosted or enrollment-platform system rather than into Fixed Rate Electric Plans marketplace forms.

No internet or information system can be guaranteed to be completely secure.

12. Your Privacy Choices and Requests

Depending on applicable law and your relationship with us, you may have rights concerning personal information, which may include rights to request access, correction, deletion, or information about how certain data is used.

You may submit privacy questions or requests using the contact information below.

We may need to verify your identity before fulfilling certain requests.

If a particular statutory privacy right does not apply to our business or to the information involved, we may still respond where reasonably practicable.

Nothing in this Privacy Policy limits rights relating to customer or proprietary client information under applicable PUCT rules.

13. Children's Privacy

Fixed Rate Electric Plans is intended for adults shopping for electricity service.

The Site is not directed to children, and we do not knowingly seek to collect children's personal information through the marketplace.

14. Third-Party Services

PowerHQ, REPs, electricity providers, and other third-party services linked to or embedded within the Site operate under their own terms and privacy policies.

Fixed Rate Electric Plans does not control those independent privacy practices.

You should review the applicable provider's privacy information when completing enrollment.

15. Changes to This Privacy Policy

We may update this Privacy Policy if our services, providers, technologies, or legal obligations change.

If we make material changes, we will update the Effective Date and publish the revised Privacy Policy on the Site.

In particular, we will review this Policy before introducing materially different practices such as customer accounts, persistent analytics, targeted advertising, or additional personal-data collection.
